What Are Drug Offences?

  • Allow premises you occupy or manage to be used for drug-taking activities

Types of Drug Offences

1. Possession of a Controlled Drug

This offence involves having a controlled substance on your person or in your property without a lawful excuse. It applies to all drug classifications and includes items like cannabis, ecstasy, or cocaine.

  • Possession of even small amounts can result in a caution or prosecution.

  • Sentences vary based on the class of drug, previous convictions, and surrounding circumstances.

2. Possession with Intent to Supply

This more serious offence involves not only having drugs but being suspected of intending to distribute them to others. The police and prosecution often rely on:

  • The quantity of drugs found

  • Packaging materials (e.g., baggies, scales)

  • Cash or large sums of money

  • Messages or call logs indicating supply (especially from mobile phone data)

  • Witness or surveillance evidence

Being charged with this offence can lead to a custodial sentence, even for a first-time offender.

3. Supply and Conspiracy to Supply

Supply involves directly or indirectly providing drugs to others. You can be guilty of this offence even if no money changes hands.

Conspiracy to supply involves planning or agreeing to supply drugs, often alongside others. These charges frequently arise in larger investigations involving:

  • Undercover operations

  • Covert surveillance

  • Cell site analysis and digital forensics

  • Searches of premises and vehicles

4. Drug Importation

Importation of drugs across borders is considered one of the most serious drug offences. These cases are typically prosecuted in the Crown Court and often involve international cooperation and extensive digital and forensic evidence.

Classes of Controlled Drugs

Drugs are classified into three categories under UK law, which determines the severity of charges and sentencing:

Examples of drugs in each category include:

Class A -Heroin, Cocaine, Crack Cocaine, MDMA (Ecstasy), LSD, Methadone, Methamphetamine (Crystal Meth)

Class B - Cannabis, Ketamine, Codeine, Amphetamines, Synthetic Cannabinoids, Mephedrone

Class C - Anabolic Steroids, Benzodiazepines (e.g., Diazepam), GHB, GBL, Khat
